1. General

These terms govern bookings and stays at Pensjonat Zofia, ul. Rzemieślnicza 7, 49-300 Brzeg.

Making a booking means the Guest, and everyone travelling with them, accept these terms.

2. Booking and the contract

  1. Bookings are made through the form on this site. A request is not yet a booking — it is an offer to enter into a contract.
  2. The Host confirms availability, normally within 24 hours, and sends an e-mail with the payment details.
  3. The contract is concluded when the payment is credited. The Host confirms this by a separate e-mail.
  4. The Guest books a room category (single, double or triple). The Host assigns the specific room and may move the booking to another room of the same category and standard.
  5. The Guest is responsible for the e-mail address and phone number provided. All confirmations are sent there.

3. Price and payment

  1. The price follows the rates in force on the day of booking and is shown in the form before the booking is submitted. It covers the accommodation, utilities, bed linen and towels. Breakfast is charged extra if selected in the form.
  2. After the dates are confirmed the Guest pays an advance payment towards the price within 3 days.
  3. If the payment does not arrive in time, the booking expires and the dates are released. The Host is not obliged to send a reminder.

4. Check-in and check-out

  1. Check-in from 14:00, check-out by 10:00.
  2. Other times are possible by prior arrangement, subject to availability.
  3. Only the number of people stated in the booking may stay in the room. Łóżeczko dla dziecka — na życzenie, prosimy o informację w uwagach.
  4. The Guest may not sublet the room or let third parties use it.

5. Rules of stay

  1. Quiet hours are 22:00–06:00. Please respect the neighbours and the other guests.
  2. Smoking is not permitted anywhere inside the building. Outside — only in the designated places.
  3. Open flames, including candles, and heating appliances other than those provided are not allowed in the rooms.
  4. Guests use the garden, terrace, barbecue and shared kitchen with consideration for others and tidy up after themselves.
  5. Pets are not allowed.
  6. Parties and visitors who are not part of the booking require the Host's consent.

6. Liability

  1. The Guest is liable for damage caused by them or by the people staying with them, and reports it to the Host without delay.
  2. The Host is not liable for belongings left in the room, nor for vehicles and their contents. The parking is unguarded.
  3. The Host is not liable for inconveniences beyond their control, such as interruptions in the power or water supply.
  4. Items left behind are kept for 14 days and, on request, sent back at the Guest's expense.

7. Changes and cancellation

  1. The Host will accommodate a change of dates where possible — please call or write.
  2. If the Guest cancels:
    • up to 7 days before arrival — full refund;
    • up to 3 days before arrival — 50% refund;
    • later, or in case of no-show — no refund.
  3. Cutting the stay short after arrival does not entitle the Guest to a refund for the unused nights.
  4. If the Host cancels for reasons on their side, they refund the payment in full, or offer alternative dates.
  5. In the event of force majeure — an event neither party could foresee or prevent — the parties agree new dates or the Host refunds the unused part of the payment.
  6. Cancellations must be made in writing or by e-mail.

8. No right of withdrawal

Under art. 38(12) of the Polish Consumer Rights Act of 30 May 2014 (implementing Directive 2011/83/EU), the right to withdraw from a distance contract does not apply to contracts for accommodation services other than for residential purposes where the contract provides for a specific date or period of performance.

In other words, the 14-day cooling-off period does not apply to a booking for specific dates. The cancellation rules in section 7 apply instead.

9. Complaints

  1. Please report any faults during the stay — that is when they are easiest to put right.
  2. Complaints may be sent by e-mail to pensjonat_brzeg@op.pl. The Host replies within 14 days.
  3. Consumers may use out-of-court dispute resolution, including the EU ODR platform: ec.europa.eu/consumers/odr.

10. Personal data

How your data is handled is described in the privacy policy.

11. Final provisions

  1. Matters not covered here are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
  2. The terms in force on the day of booking apply. Changes do not affect bookings already confirmed.
  3. Translations are provided for convenience. In case of discrepancy, the Polish version prevails.
